AN OPEN LETTER TO NUSKIN DISTRIBUTORS WORLDWIDE
Is your Nu Skin business protected?
Employees are protected by Labour Laws.
Are there any laws that protect your Nu Skin business?

Dear fellow Nu Skin distributors,

We once shared the same dreams – to achieve success in the Nu Skin business, to enjoy a life of freedom…The road to success in the Nu Skin business is not an easy one. However, to realise our dreams, I believe you are doing what I did – that is, to promote the Nu Skin business whenever and wherever you can as if it's a ‘religion’.

Let me take this opportunity here to express my deepest regret for the difficulties you face as a result of the damaging publicity about the court case between the Blue Diamonds Team and Nu Skin, and alleged tax evasion by Nu Skin. If Nu Skin were reasonable and sincere about the resolution, the Blue Diamond members would not have fought so ferociously. After all, we are a group of distributors who once dedicated our lives to the Nu Skin business. In return, what we got was Nu Skin's unfair, unhuman, brutal and bullying treatment.

More important than monetary losses, they caused a severe blow to our self esteem. Some Blue Diamond members who have been cut off bonuses that support their livelihood are thrown into financial hardship, some contemplated suicide, their properties and cars repossessed by the banks, families fall apart. They have nothing left to their names despite having dedicated years to Nu Skin.

Tens of Blue Diamond distributors who once devoted their lives to Nu Skin had been struck off the list for some bogus offence. Their bonuses stopped.

There is no protection to the Nu Skin business we worked a big part of our lives to build. How about yours? How can you be sure you won't be the next bullying target?

Of all the American network marketing companies that adopt the integrated global compensation system such as Amway, …, none of the distributor agreement is with the US head office. All of them are between the joining party and the Taiwan local distribution company. The agreement states that it's bound by the local Taipei jurisdiction. Therefore, the local Taiwan distribution company should bear the legal responsibilities for any disagreements in rights with its direct sales distributor. Nu Skin is the only company that has two distributor agreements. The main agreement is with the American head office bound by laws in Utah. Nu Skin recruits distributors in Taiwan but claims that the distribution business is in the U. S. Disputes between Nu Skin and its distributors have to be dealt with in Utah. Nu Skin Taiwan has no legal responsibility to deal with disputes. These are all referred to Nu Skin in the U. S.

My fellow distributors – please take note – if our distributor rights are violated by Nu Skin, we cannot sue Nu Skin U. S. in Taiwan for compensation, because Nu Skin U. S. does not have a trading address, business registration or asset in Taiwan. Nu Skin Taiwan is merely the Nu Skin U. S's product agent and is not directly related to Nu Skin U. S. Can you imagine us taking on Nu Skin U S in the courts of Utah? The Nu Skin business that we give our lives to build is not protected. Does yours have any legal protection?

Network marketers always have a united front. Network marketing companies and network marketers should also be united. But Nu Skin often has an opposing stand to its distributors. Recently, Nu Skin brought out an even harsher policy demanding Blue Diamond members sign an agreement – that if any downline members break any rules, then six generations of uplines will be penalised. In serious cases, their agreements can be terminated. Why should the uplines be penalised for the downlines’ offences? My fellow distributors, where is the protection for the Nu Skin business you devoted your time and lives to develop?

The monetary loss and psychological damage to me is small when compared to the damage Nu Skin does to the smaller individual distributors around the world bullying them with its financial prowess. I haven't exposed the truth to avenge Nu Skin's treatment. My only intention is to warn all Nu Skin distributors and the general public. That you should open your eyes and see the truth so that you won't follow our footsteps – devote years of hardwork to build a business that has no protection, only to suffer financial losses and damage to yourself physically, psychologically and spiritually.

Nu Skin's Four Way trap:

One
There're two agreements between Nu Skin and the joining parties. The Independent Distributors Agreement with Nu Skin U. S. with bonus schemes. The Purchase Agreement with Nu Skin Taiwan only for product purchase but without the bonus schemes. Nu Skin Taiwan which has a total registered capital of Taiwan Dollars 8 millions, is only the Taiwan product distribution agent for Nu Skin U. S. The two companies are completely separate legal entities. However, Nu Skin promotes Nu Skin Taiwan as a subsidiary of Nu Skin U. S. to its distributors. The same misrepresentation by Nu Skin applies worldwide in 38 countries.

Two
The International promotions part of the Independent Distributors Agreement is governed by Utah laws. To avoid legal responsibilities, Nu Skin Taiwan requires senior ranking distributors who have disputes with Nu Skin (over issues such as termination of distributor rights and bonuses) to take legal action in Utah. Nu Skin can make up any policy violation cases to terminate the distributors bonuses unilaterally without consultation with the distributors themselves. What legal protections are there for the rights of the high ranking distributors? Again, Taiwan is not alone – Nu Skin operates in the same way in all of its 38 markets around the world.

Three
The compensation plan is signed with Nu Skin U. S. Nu Skin Taiwan testifies in Taiwanese court that” Nu Skin Taiwan is only an agent for Nu Skin U. S, distributing bonuses on their behalf. However, Nu Skin Taiwan does report these payments on behalf of Nu Skin U S as commissions under their own business expenses, which according to the tax laws of Taiwan, is tax avasion and therefore illegal. Similarly, the same mode of operation applies to Nu Skin's 38 markets worldwide.

Four
After terminating the bonus payments of high ranking distributors using bogus reasons, Nu Skin further attacks its victims personal image. Not only do the victims suffer significant financial losses, they're also subjected to psychological torture. Nu Skin practices this form of bullying in all the 38 markets it operates worldwide.

Those who set up traps will eventually fall into their own traps. What goes around comes around. Those who appear to be winning cannot escape the Laws of Nature forever. I appeal to all of you fellow Nu Skin distributors, who have suffered as a result of Nu Skin's unfair agreements, to join our International Nu Skin Victims Committee. I will assist you based on my knowledge about the legal prosecution procedure against Nu Skin's unfair and unreasonable contractual arrangements to press charges through the Tax Office and other relevant departments in your country.

Let us unite together to fight for the distributors rights for ourselves and our downlines. More importantly, for a more just society.

致美國NUSKIN總裁羅百禮的公開信 百禮弟兄平安:願以一段的禱告文來開始今天的書信....〔親愛的主耶穌,我們愛你,你的愛拆毀人與人中間隔斷的牆,你為我們的罪被釘死在十字架上,你的寶血洗淨了我們的罪,讓我們能與神合一,也能與人合一,你是那源頭,是那拆毀人與人中間仇恨隔斷的牆,使人合一和睦的源頭(以弗所書 2 : 14),願你的公義在我與如新集團爭議上做仲裁,也讓我與百禮弟兄能藉著以下書信能有很好的交通,以上奉主耶穌的名求,阿們!〕首先我為如新集團台灣經銷公司負責人周由賢涉嫌非法逃漏稅,詐欺直銷商獎金,教唆偽證,偽造文書,誹謗等刑事案件,與百萬美元名人欒嵋及千萬美元名人宋德奇涉嫌偽證,深感極度難過,一個曾把如新當做生命與信仰經營的直銷商,如今卻被逼,被迫害成為一個對抗如新集團的直銷商,而我深愛如新事業的心至今仍是不變,這也是我再度提筆給你寫這封書信的主因,在此也以主內姐妹的身份對你提出嚴正的聲明與忠告,如新集團現正處以一個非常的危機之下,二十年前你以五千美元開創了如新事業,二十年後的今天如新集團已成為國際知名的企業,你的創業精神實令人感佩,如今神也藉著此次危機事件,正在考驗如新集團對危機處理的能力與智慧,身為一個被如新集團以 ”莫須有”違規罪名停權的受害者,在與如新集團訴訟與抗爭三年後的今天,重大發現如新集團正處以下七項危機當中:危機一:如新集團與全球參加人所簽訂的協議書必須由原訂的兩張修改成為一張如新集團與參加人簽訂兩份協議書,一份是與美國如新公司簽訂的是謂〔獨立直銷商協議書〕,一份是與當地經銷公司簽訂的是謂〔產品訂購協議書〕,那份與美國如新公司簽訂的獨立直銷商協議書,其有效性令人懷疑,因美國如新公司未曾按協議書內容之銷售獎勵計畫支付給參加人任何直銷獎金(參附件一).危機二:產品訂購協議書並無獎金(佣金)支付條款,如新台灣經銷公司將支付給參加人的直銷獎金帳列其營業費用之佣金支出,與台灣稅法不合,因而涉嫌非法逃漏稅(參附件二)危機三:周由賢不當串聯百萬美元名人欒嵋及千萬美元名人宋德奇出庭所供證詞 ”代收代付” (台灣如新代理美國如新支付直銷獎金給參加人),因而涉嫌偽證(參附件三),使如新集團陷入涉嫌非法逃漏稅的危機中,周由賢應負疏失之責危機四:獨立直銷商協議書其有效性令人懷疑,而產品訂購協議書又無違約條款,因而全球所有曾被如新集團依違約罪名處分的直銷商皆可向如新集團請求賠償危機五:周由賢涉嫌關說行政院公平會,已被有關單位掌握證據,此事件若再度被媒體揭露,對如新集團的聲譽與形象會有再度重大打擊危機六:如新集團在台所涉嫌之非法行為,將嚴重影響如新集團進軍中國大陸市場危機七:全球如新直銷商可能對如新集團瀕臨信心危機,如新集團的股價亦可能將受到崩盤考驗"七"是神行政經綸的數字,在神的公義下罪惡無法隱藏,試圖關說,賄賂法官是神所厭惡的,因神才是真正的審判者,隨函附上取自荒漠甘泉的靈修經句,這是支持我抗爭被如新集團不合理停權的力量來源(參附件四),今日我以主內姐妹的身份向你提出七項危機的忠告,願神賜給你智慧與能力來挽救及處理如新集團所處之七項危機.親愛的百禮弟兄,可曾記得2001年9月,我曾語重心長的寫一封信給你(參附件五),而對你親筆的回函深表感謝(參附件六),遺憾的是,此信用卡烏龍事件並無得到合理妥善的處理而導致三年後的今日,延伸成為嚴重不可收拾的事件,身為如新集團台灣經銷公司的負責人周由賢自應負其責。最後我再度以最沉痛的心情告知你,近日我將向臺灣台北地方法院,針對如新集團不給付我近新台幣二千萬的直銷獎金提出詐欺案刑事告訴,涉嫌此共同詐欺案件將有百礼弟兄你本人,如新國際執行副總裁林克禮(Corey Lindley),如新國際股份有限公司直銷商紀律部聯絡人Brian Muir,基於你我在主耶穌基督內同是一家人的份上,在我向法院提出告訴之前,希能接獲你親筆回函,請你來函答覆我,你個人將以如何的態度及積極的方法,妥善處理如新集團因錯誤終止我直銷權所引發相關事件而造成對全球NUSKIN直銷商所形成的傷害? 你又將如何因應如新集團所處上述七項危機? 對於你的親筆答覆函將不勝感激... 願主耶穌基督的恩常與你同在,更願主耶穌基督賜給你智慧與能力,妥善處理如新集團目前及將來所面臨的任何危機.....夏威夷藍鑽陳美玲 姐妹nuskin921@yahoo.com.tw
